Detention Review
At Anwari Law PC, our Toronto, Ontario immigration lawyers represent individuals who are being held in immigration detention in Canada. If you or a loved one has been detained by the Canada Border Services Agency (CBSA), you have the right to a detention review hearing before the Immigration and Refugee Board of Canada (IRB).
What is a Detention Review?
A detention review is a legal hearing where the Immigration Division of the IRB decides whether a person should remain in immigration detention or be released. During the hearing, the Board reviews the reasons for detention and determines whether continued detention is justified.
When Does a Detention Review Occur?
Under Canadian immigration law, detention reviews are held at specific intervals:
First review: Within 48 hours of detention
Second review: Within 7 days after the first review
Subsequent reviews: Every 30 days if detention continues
At each hearing, the IRB assesses whether the person should be released with conditions or remain detained.
Reasons for Immigration Detention
An individual may be detained if authorities believe:
They may not appear for immigration proceedings or removal
They pose a risk to public safety
Their identity has not been confirmed
There are security or criminal concerns
